Nofence Hardware Warranty Policy

This Warranty Policy (the ”Warranty Policy”) applies to all purchases of Nofence’s livestock collar and associated hardware components, as set forth in the Order, purchased from Nofence or one of Nofence’s authorised distributors, and in each case, is configured by Nofence for use with the Software in connection with a Subscription.
1.1.1 Any purchase and use of the Solution is governed by Nofence's Product and Subscription Terms which can be found on Nofence.com, on Nofence's customer account pages, and the relevant Order through which the Subscriber has purchased the Solution.
1.1.2 For the avoidance of doubt, all definitions used herein shall have the meaning set forth in the Product and Subscription Terms unless expressly stated otherwise.
1.1.3 This Warranty Policy, together with the Product and Subscription Terms, are referred to as the Agreement.
2.1 Nofence Warranty
2.1.1 The general warranty period for products covered under this Warranty Policy is 5 years from the date of shipment (“General Warranty Period”).
2.1.2 Certain Hardware models have an extended warranty period deviating from General Warranty Period. For the Hardware listed below, the warranty period listed for each item will apply instead of the General Warranty Period (“Extended Warranty Period”) :
Nofence N3 collar and N3 chain, strap, and battery; 10 years from the date of shipment
(General Warranty Period and Extended Warranty Periods are jointly referred to as the “Warranty Period”)
Provided that the Subscriber is not in breach of any of its obligations in the Product and Subscription Terms, Nofence warrants the Hardware against defects in workmanship, materials and design under normal use (“Normal Use”) for the applicable Warranty Period. “Normal Use” includes use of the hardware on cattle, sheep, or goats in outdoor grazing environments in accordance with the Knowledge Hub. Such use includes exposure to weather, vegetation, soil, animal movement, rubbing, and impacts typical of animal husbandry, as well as temporary exposure to water within the hardware’s specified ingress protection rating and operation within the defined environmental temperature limits. Normal Use excludes intentional misuse; use on animals other than cattle, sheep, or goats; prolonged or repeated water immersion beyond the specified ingress protection rating; operation outside supported environmental or storage limits; indoor use; continuous or repeated contact with feeding, containment, or similar equipment that is identified as rigid in the Knowledge Hub; and use contrary to installation, handling, charging, or storage instructions. If Nofence releases lifetime-extending products for any Hardware, the Subscriber is required to utilize them whenever provided by Nofence at no extra cost or as part of the initial purchase price. Nofence may, acting reasonably and in its sole discretion, determine whether a particular use falls within the scope of Normal Use described above.
Nofence is under no circumstances responsible for faults discovered after the expiration of the Warranty Period.
2.1.2 The Warranty Period shall also apply to any second-hand purchases so long as the Subscriber can prove that the specific Hardware is still within the Warranty Period.
2.2.1 This Warranty Policy does not apply to: (a) the gradual deterioration of the Hardware as a result of the Normal Use, (b) surface damage such as scratches and notches in the Hardware, or abrasion to the solar panel, provided that such damage does not compromise sealing or reduce solar charging performance by more than 50%; (c) damage as a result of accident, misuse, wrongful use, fire, earthquake, force majeure or other external factors; (d) damage as a result of use contrary to Nofence Knowledge Hub and contrary to the Normal Use of the Hardware; e) to any defect or damage resulting from failure to perform required maintenance according to the Knowledge Hub (e) damage as a result of repair service executed by a person who does not represent or is not affiliated with Nofence; (f) Hardware that has been altered without the prior written consent of Nofence; (g) any damage to property or persons as a result of animals moving outside of the grazing area which is caused by a malfunction of the Hardware. Nofence is under no circumstances responsible for direct or indirect economic losses due to Hardware faults, and the limitation of warranty and limitation of liability as set out in the Product and Subscriptions Terms applies to this Warranty Policy.
3.1.1 To make a warranty claim covered by this Warranty Policy, please contact Nofence support.
3.1.2 The notice needs to include the following: (i) the reasons for providing the notice, (ii) when the situation was first discovered, (iii) the Order and (iv) any other information the Subscriber deems as relevant.
3.1.3 To assess a warranty claim, Nofence may require the subscriber to cooperate with an investigation, including providing relevant usage, environmental, animal, and photographic information. If sufficient information is not provided, Nofence may be unable to process the warranty claim.
3.1.4 Nofence will not consider the warranty claim notice without the presentation of proof of purchase or proof of ownership of the Hardware, and the obligations of Nofence under this Warranty Policy are subject to the Subscriber providing such proof of purchase.
3.1.5 The warranty claim notice must be submitted no later than 30 days after the Subscriber discovered or should have discovered the defect.
3.2.1 Should a warranty claim as detailed in the notice be covered by this Warranty Policy, Nofence may upon its own discretion decide if it offers repair or replacement to the Subscriber. If replacement is offered by Nofence, then Nofence may choose Hardware replacement with the provision of refurbished or new Hardware. The Subscriber will be provided Hardware in the same or newer model or an alternative product that Nofence determines provides comparable characteristics to the original Hardware.
3.1.2 In the event of the replacement of Hardware, this warranty will continue and remain in force for the remainder of the original Warranty Period.
4.1.1 Returns may not be made unless Nofence has specifically consented to the return or the return is subject to clause 3 of this Warranty Policy.
4.1.2 The Subscriber will be responsible for the cost of delivery and will have to ensure that the method of delivery does not result in any damage to the Hardware.
4.1.3 To request a return, the Subscriber shall contact Nofence using the contact details in clause 3 of this Warranty Policy. The authorised Nofence representative who approves any returns will also inform the Subscriber of the address of delivery and any relevant time frames for making the delivery.
4.1.4 When making a return request, the Subscriber shall provide the reasons for providing the request, the Order and any other information the Subscriber deems as relevant to any such request.
